Legal threat could cause major Quirke Road hold-up

Date Published: 12-May-2011

BY FRANK FARRAGHER

THE €10m Seamus Quirke road enhancement project could face a major delay after it emerged this week that lands encroached on by the contractor had not been legally secured by the City Council.

Work has now stopped on part of the project that started last October at the Dúnárás apartment block beside the Fort Lorenzo roundabout, after the owners of the property engaged in legal correspondence with the City Council on the issue.

The Galway City Tribune understands that the owners of the Dúnárás apartments – used mainly for student accommodation – are claiming that there was encroachment on their property without any agreement having been reached with them on compensation.

Negotiations have been going on for some weeks in an effort to reach agreement on compensation terms between the City Council and Dúnárás – however, the Galway City Tribune has learned that there is a ‘significant difference’ between the sides on this issue.

Although it hasn’t been confirmed by either side, the compensation figure sought could be in the region of €200,000 – if no agreement is reached after arbitration, then the City Council could have to go down the road of getting a compulsory purchase order on the lands, a procedure that could take a year to 18 months.
