SUPREME COURT QUASHES FINDING OVER EYRE SQUARE CONTROVERSY

The Supreme Court has quashed the finding by an arbitrator that Galway City Council behaved unreasonably towards a construction company hired to renovate Eyre Square.

In October 2008 the High Court upheld the arbitrator’s decision, who was chosen to settle the dispute, between the city council and the contractor Samuel Kingston Construction.

Today however the Supreme Court ruled that the arbitrator had misconducted the arbitration and that in itself was a ground for his removal.

Samuel Kingston Construction ceased work on the site in June 2005 – 17 months after it had started the refurbishment project.
