Legal opinion validates decision on city refuse service

Last month, councillors objecting to the plans submitted a section 140 to the local authority requesting the service be retained.

They also sought independent legal advice which has now been received.

In conclusion it states that ‘an invalid act, is an act which a court will declare to be invalid, and that if a resolution was passed by the elected members seeking the city manager to retain the service it would contravene section 140 subsection 10 of the local Government act’.

City Councillor Peter Keane says he will not be challenging the plans any further.
