Galway man acquitted of charges involving fraudulent use of trademark

Galway Bay fm newsroom – Three men, including a Barna native, accused of the fraudulent use of clothing company Abercrombie & Fitch’s trade mark have been acquitted by direction of the trial judge.
43 year old Mark McCarthy of Homeleigh, Porterstown Road, Dublin 15, had pleaded not guilty to possession and distribution of goods or material bearing a mark identical to or nearly resembling a registered trade mark within the state on dates between February 4th, 2007 and February 11, 2008.
46 year old Michael McCartan of Carraig An Iolair in Barna had pleaded not guilty to possession of similar goods at McCartan and McCartan, Millennium Business Park, Snugborough Road, Dublin 11 on February 11, 2008.
40 year old Peter Rafter of Southmede, Ballinteer Road, Dundrum had pleaded not guilty to possession of similar goods at RB Menswear, Powerscourt Town Centre on May 23, 2008.
Judge Sarah Berkeley directed the jury of five woman and seven men to find the men not guilty following a day of legal argument during which issues were raised in relation to the maintenance of the exhibits in the case.
