Council wins High Court case against quarry

GALWAY City Council was successful yesterday in securing an order of court against Lackagh Quarry Group Ltd which will now legally prohibit the developers from excavating to levels outside the bounds of their planning permission at the company’s quarry in Menlo.
The case, which has been ongoing for a number of years, finally came to a conclusion at the High Court in Castlebar with the Council winning full costs from the developers.
Mr Justice Paul Gilligan ruled that the developers must comply with the planning permission guidelines from the City Council that they may not excavate to a level any deeper than 15 metres at the Menlo site.
City Council officials had been pursuing Lackagh Quarry Group Ltd in relation to their excavations at Menlo since it was first discovered that the company had quarried deeper than the 15 metres outlined in its planning permission.
Their case was given weight by a number of complaints from local residents and city councillors who expressed concern that the deep excavations would impact on the safety of the city’s water supply.
