City health and safety trial adjourned to next week
Galway Bay fm newsroom – The trial of a company director charged with breaches of Health and Safety legislation, has been adjourned to next Tuesday.
It follows the death of one of his employees at the Connacht Rugby Sportsgrounds in the city five years ago.
40 year old Colin Murphy, with addresses at Galway Road, Tuam and Killeeneen, Craughwell, and who currently lives in England, was a director of CDM Steel Ltd., which went into liquidation on the day of the accident.
Mr Murphy appeared before Galway Circuit Criminal Court this week where he pleaded not guilty to five breaches of Safety, Health and Welfare at Work legislation, in that as director/manager of the company he failed or neglected to implement safety measures as far as was practicable to ensure the health and safety of his employee, foreman, Declan Byrne, at his place of work at Connacht Rugby Sportsgrounds, College Road on April 30, 2008, as a result of which Mr Byrne sustained fatal injuries and died.
Judge Rory McCabe told the jury that a difficulty had arisen in the trial which meant it could not proceed further this week and would resume next Tuesday.
One juror indicated he would be out of the country next week and it was agreed to continue with eleven jurors.
Judge McCabe asked the remaining eleven jurors to return on Tuesday.
