SENTENCING DEFERRED IN GORT CHILD PORNOGRAPHY CASE
Date Published: 23-May-2012
The sentencing of a Gort man over a child pornography offence has been deferred until July.
Noel Murphy of 2 Sheehaun, Ballysheedy in Gort appeared before Galway Circuit Criminal today [May 23] where the matter was referred to the probation services.
Dublin born Murphy had pleaded guilty to one count of possession of child pornography when he was arraigned in January.
He was first arrested on June 2nd last year [2011] and was later charged.
641 images of category two child pornography were identified after completing a forensic examination of computer media seized.
The images were burnt over several sessions between 11th June 2006 and the 4th December 2009.
At Galway Circuit Criminal Court today, evidence was provided from a consultant psychologist that the defendant now accepted what he did was wrong and also accepted that the images were porn and not an art-form.
Judge Raymond Groarke raised concerns that the man had on previous interviews said the images were art and also highlighted concern that an item of child’s underwear was found in the boot of his car during the investigation which Murphy maintained belonged to his girlfriend.
The consultant psychologist said he didn’t believe the man posed a serious risk, had been compliant with medication and had not been admitted to hospital since 1996.
He suggested that Murphy is formally assessed by the probation service for consideration under the RM 2000 risk assessment.
Judge Groarke described the case as appalling and said he was concerned as to the risk posed by the defendant going forward.
He then referred the matter to the probation service and adjourned sentencing pending its inquiry until July 9th.
